Cílem disertační práce bylo prozkoumat institut veřejného zájmu z několika jeho úhlů pohledu a perspektiv. Svou povahou se jedná o průřezový pojem, který se uplatňuje prakticky ve všech činnostech veřejné správy. Institut veřejného zájmu, který existuje v různých podobách již několik tisíciletí, nepochybně prokázal svou funkci a spolu s principem, že veřejná správa je službou veřejnosti, jej lze považovat za materiální jádro veřejné správy. Je vysvětleno, že rozdíl mezi veřejným a soukromým zájmem existuje přesvědčivě; i když hranice není v praxi dokonale ostrá. Disertační práce vysvětluje princip ochrany veřejného zájmu ve smyslu správního řádu. Vyjdeme-li z přesvědčení, že veřejný zájem je určitým směrem či cílem (zájmem, hodnotou), který právní řád vyžaduje chránit, pak ochrana tohoto cíle musí představovat stálou a neustálou potřebu činit vše potřebné k ochraně tohoto cíle. Několik kapitol bylo věnováno interpretaci obdobných pojmů - obecný zájem, kolektivní zájem a veřejné blaho. Práce se snaží najít způsob, jak kategorizovat veřejné zájmy z hlediska sektorového a speciálního, dále kategorizovat zájmy na zájmy rozvojové, ochranné a chránící život a zdraví člověka. K dalším otázkám patří posouzení, zda jsou některé veřejné zájmy svou povahou nadřazeny jiným veřejným zájmům nebo zda mezi nimi existuje rovnoprávný vztah. Ze samotné konstrukce pojmu veřejný zájem lze usuzovat, že jsou v podstatě stejně kvalitní a významné, což potvrzuje řada soudních rozhodnutí popsaných v této práci. V některých právních předpisech se odkazuje na důležitý a závažný veřejný zájem, tj. tam, kde obsah právních předpisů jasně naznačuje snahu zákonodárce rozdělit veřejné zájmy na jednoduché a kvalifikované. Účelem kvalifikovaných veřejných zájmů je spojit nějaký důsledek v právu (nejen správním) s tím, že se nejedná o pouhý veřejný zájem, ale že tento zájem bude v daném případě samozřejmě posílen, bude mít kvalifikovanou formu. Tato práce se také zabývá myšlenkou, že veřejné zájmy představují jakési prototypy ústavních práv, kterými by se mohly postupně stát. Práce zmiňuje, že pro některé veřejné zájmy již byla zahájena teoretická příprava začlenění do ústavních práv, a to u práva na vodu. Disertační práce se také zabývá střetem veřejných a soukromých zájmů, jakož i střetem veřejných zájmů mezi sebou. Závěrečná část práce se zabývá komparací veřejného zájmu na ochraně přírody podle českého práva s právním řádem Velké Británie.

The aim of the dissertation was to examine the institute of public interest from several of its points of view and perspectives. By its nature, it is a cross-cutting concept that is applied in virtually every activity of public administration. The institute of public interest, which has existed in various forms for several millennia, has undoubtedly proved its function and, together with the principle that public administration is a service to the public, can be considered the material core of public administration in general. It is explained that the distinction between public and private interest exists convincingly; although the line is not perfectly sharp in practice. The dissertation thesis explains the principle of public interest protection as defined by the Administrative Code. If we proceed from the conviction that the public interest is a certain direction or goal (interest, value) that the legal order requires to protect, then the protection of this objective must represent a constant and unceasing need to do everything necessary to protect this goal. Several chapters were devoted to the interpretation of similar concepts - general interest, collective interest and public good. The thesis tries to find a way to categorize public interests from the sectoral and special point of view, as well as to further categorize interests into development, protective and life and health protection interests. Other issues include assessing whether some public interests are by their nature superior to other public interests or whether there is a relationship of equality between them. From the very construction of the concept of public interest, it can be assumed that they are essentially of the same quality and importance, which is confirmed by a number of court decisions described in this thesis. In some legislation, reference is made to important public interests, i.e. where the content of the legislation clearly indicates an effort of the legislator to divide public interests into simple and qualified. The purpose of qualified public interests is to link some consequence in law (not only administrative) to the fact that there will not be a mere public interest, but that this interest will obviously be strengthened in the given case, will have a qualified form. This thesis also discusses the idea that public interests represent some kind of prototypes of constitutional rights, which they could gradually become. The thesis mentions that for some public interests, the theoretical preparation of incorporation into constitutional rights has already begun, namely the right to water. The dissertation also deals with the conflict of public and private interests, as well as the conflict of public interests among themselves. The final part of the thesis deals with the comparison of the public interest in nature protection under Czech law with the law of Great Britain.
