|
The course represents the core subject of the second pillar of the study programme focused primarily on the development of knowledge and professional skills of the student and is intended for students of the specialization Administrative Law. The essence of the course is the development of the student's ability to develop at a high professional level, in appropriate depth and with reflection not only of national, but also European and international regulations to elaborate the assigned topic related to a very narrow sub-issue or case of administrative law. The student must comprehend and elaborate the given topic not only from a correct and legal theoretical perspective, but also from a practical perspective, i.e. with a focus on possible interpretation and application problems of the given issue from the perspective of the practice of administrative authorities and courts. The preparation must be based not only on a precise analysis of Czech and international legislation, but also reflect the findings of administrative doctrine, as well as thoroughly work with the relevant case law of Czech and European courts. The student must also be able to present the assigned topic scientifically. Therefore, both semesters of Philosophical and Methodological Foundations of Law and both semesters of Scientific and Pedagogical Propaedeutics are prerequisites for the course. The essence of the course is the student's participation in professional seminars in which students are given course assignments. They have to process and solve them by means of self-study according to the requirements of the lecturer of the seminar and then present them at the professional lecture not only to this lecturer but also to other students of the study programme in such a way that they stand up to the subsequent scientific discussion that their solution and presentation will trigger. In the presentation, emphasis is also placed on the presentation of the chosen methodological approaches as well as the literature and case law used by the student. The seminar is designed as a four-semester course, with emphasis on selected institutes of administrative law in each semester. The fourth semester focuses primarily on selected aspects of legal guarantees of legality in public administration with an emphasis on judicial review of public administration, and thus particularly on the institutes of administrative and constitutional justice. However, given that this study programme involves graduates of a Master's degree programme, knowledge of the whole issue of administrative law at the appropriate level and context, as well as links to other disciplines (e.g. constitutional, criminal, private, European, etc.) is assumed.
Students who have completed this course will gain the knowledge necessary to understand the features of law.

Completion of this course is conditional upon the completion of the courses Philosophical and Methodological Foundations of Law I., II. and Scientific and Pedagogical Propedeutics I., II. and Administrative Law Seminar I. - III.

Assessment methods and criteria
|
Student performance
Active participation in 80% of seminars (full-time students), including a presentation on the given topic. A student of the combined form must participate in at least 30% of the seminars and an individual consultation of two hours.
