Course content
1) Evidence as notion of civil proceedings. Procedural evidence v. logical evidence. Material nad formal truth in the Czech civil proceeding. Conflict concerning evidence as conflict between Parliament and courts. 2) Process of facts finding in relation to other courts´ activities. Evidence in non-contentious proceedings. 3) Evidence in contentious proceedings. Static and dynamical aspect of burden of proof. 4) Degree of evidence. Facts establishing law and denying it. Negative theory of evidence. Deficit of information. 5) Assessing on probability. Ways of solution. Pretrial discovery. 6) Concentration principle and its consequences. Premature concentration. Proceedings without hearing. 7) Means of evidence, testimony, psychological aspects. 8) Expertise. Role in civil proceedings, independent judging of evidence. 9) Expertise - graphology I 10) Expertise - graphology II 11) Expertise - medicine doctors, damage reimbursement, affiliation. 12) Expertise - economic issues, building technologies.

Learning outcomes
The course brings more information to information gained in courses of Civil Procedure Law and focuses on questions concerning evidence. Taking of evidence is the most important part of court´s hearing and rules, which had to be obeyed, are not only very complicated, but also of extreme importance for the result of the dispute. The course is therefore giving the students deep information on theories of evidence and gets them over practical experience with taking of evidence in choses cases. Special attention will be draught to witness testimony and expertise. The course will be composed of seminars held by experts from all the fields dealing with expertise; such are psychologists or judicial experts. The tutors are one academic and one specialist in the field of graphology.
Students will gain information on facts finding in civil proceedings and taking of evidence. These information will be important especially for writing of actions and facts declaration and will be useful fot their future praxis.
Prerequisites
The completion of this course is not conditioned upon completion of any other courses.

It is essential that those students who would like to pass the course must have attendance within the scope set by the seminar teacher and succeed in the colloquium.
