Course content
|
1. Privacy, the right to privacy. Personal data. Right to information. Public administration. History of protection personal data. 2. Legal regulation of personal data protection? constitutional aspects, selected issues from case law, constitutional collision guaranteed rights. Privacy Policy I.- concept, principles, processing, security. 3. Protection of personal data II. - retention, random collection, sub-questions. Privacy Policy III. - European aspects (EU legislation, Council of Europe). 4. Means of legal protection I.- the right to explanation, the right of removal, the right to compensation. Legal resources Protection II. - complaint, judicial protection. Selected case law. 5. Collision of privacy and right to information I.- recipients of public funds; public administration, internal guidelines and personnel regulations (practical examples). Conflict of privacy and rights for information II. - environmental information (practical examples). 6. Conflict of privacy rights and information rights III. - municipalities (practical examples). Current trends in conservation personal data in the world and in the EU. Suggestions de lege ferenda.

Learning outcomes
|
The course is focused on a more detailed analysis of the issue of personal data protection, which is in the light of increasing the number of personal data held by the public administration. The graduate of the course gains comprehensive information on the legal regulation of personal data protection within the Czech Republic, and also on legal regulation within the European Union and the Council of Europe. In addition to the analysis of basic legal regulations in this section, it will be the subject studies on selected judgments. Students will thus gain an overview of developments in the field of interpretation of individual terms associated with the protection of personal data Then they will be able not only to orientate themselves in the legal regulation, but through the help of case studies will acquire skills in the context of real regulation application.
The graduate of the course will gain comprehensive information on the legal regulation of personal data protection within the Czech Republic, and also on the legal regulation within the European Union and the Council of Europe. They will then be able not only to orientate themselves in the legislation, but will also acquire skills in the context of the real application of legislation through case studies.
