Course content
Content (themes): - Migration of Muslim refugees - New challenges for private international law in EU countries - Cultural differences in legal systems - Basic sources of Islamic law - Legal philosophical approach to the issue - Mps, family law and public order in the EU - Differences in legislation and legal procedures. - Protective mechanisms and ordre public doctrine - Judicial and legislative procedures influenced by the tradition of Islamic law. - Tradition of Islamic family law - "polygynous family" - Private and unilateral divorce decisions - Marital maintenance obligations - Marketing standards and traditions - Prohibitions and exceptions in Islamic law - Communities as legal enclaves - Future development

Learning outcomes
International relations are imbued with the dynamics that result from different sort of international private law relations. The aim of the course is to enable students to recognize and expand their own potential of key competences, ie characteristics, motives, opinions, knowledge and skills, and to teach them how to use these resources to achieve effective performance in the context of multicultural change and migration, with an emphasis on EU MPS; to acquaint them with what is meant by Islamic law, Sharia and what characterizes the legal environment; The course provides students with relevant knowledge and presents them as correct and analytical research questions. It has the ambition to help master EU MPS methods in their basic comparative comparisons. The subject responds to the need arising from the legal and cultural perspective in the EU. Teaching techniques will be developed and adapted to this need, making graduates better prepared for both client conflicts and conflicts that arise between clients due to interpersonal collisions.
The graduate gains knowledge about conflict of law and culture and methods of its constructive solution. They will become acquainted with what is Islamic law, sharia, how it is characterized, from which sources it is based and on what principles it is implemented. They will be able to follow the sources of law, respecting the specifics of relations with foreign elements and Islamic legal issues, to structure the process of conflict resolution in the EU MPS. They will have an overview of the areas of application of public policy reservations and will know the specifics of international approaches to Sharia law.

participation requires fluent English or German depending on the course language

Assessment methods and criteria
Student performance

An active participation in lectures and a written final test is required to obtain the credit. A colloquium with a practical focus is required to complete the subject.
