Course content
Overview of the Legal, Institutional, and Regulatory Framework - Hague Conference on Private International Law UNCITRAL - UNIDROIT - Creation of a European judicial area Jurisdiction of courts in civil and commercial matters (EU law, international law, national law) - Conflict of legal sources - Hague conventions and the Czech act on international private law Rules governing the jurisdiction of courts in civil and commercial matters (Brussels I) Rules governing the jurisdiction of courts in civil and commercial matters (Brussels I, 4/2009 Regulation) Rules governing the jurisdiction of courts in matrimonial and other matters (Brussels IIa, The Hague Convention on the Civil Aspects of International Child Abduction, intercountry adoption, matrimonia claudicantia?) Succession with a foreign element (EU law, international law, national law) Taking of evidence abroad in civil and commercial matters, legalization of foreign public documents (EU law, international law, national law) Service abroad of judicial and extrajudicial documents (EU law, international law, national law) Recognition and enforcement of judgments in civil and commercial matters (Brussels I, Brussels IIa, regulation no. 4/2009, european enforcement order, European order for payment procedure) International insolvency proceedings International arbitration

Learning outcomes
International Privat Procedural Law is a part of Private International Law and covers the following main subjects. The jurisdiction of national courts in international civil and commercial disputes, and jurisdictional immunities. Secondly, the recognition and enforcement of decisions of foreign courts. The 1968 Brussels Convention on Jurisdiction and Enforcement represents the beginning of a harmonization programme of procedural law within the European Union which has been one of the most striking developments in this field. Harmonization attempts at the international level by the International Institute for the Unification of Private Law (UNIDROIT) and the American Law Institute (ALI) resulted in the ALI/UNIDROIT Principles and Rules of Transnational Civil Procedure. This Course is intended as a starting point for research on International Law of Procedure.
Students who have completed this course will gain theoretical knowledge.
Prerequisites
The completion of this course is not conditioned upon completion of any other courses.

It is essential that those students who would like to pass the course must have attendance within the scope set by the seminar teacher and succeed in the colloquium.
