Content (themes): 1. Out-of-court dispute resolution (introduction, concept, advantages and disadvantages) 2. Alternative Dispute Resolution (ADR) and its some forms (negotiation, partnership, mediation, conciliation, ombudsman; relationship to arbitration) 3. Arbitration (introduction, concept, arbitrability) 4. Arbitration agreement 5. Person of the arbitrator 6. Arbitration proceedings 7. Arbitral award (recognition and enforcement of the arbitral award) 8. The role of general courts in arbitration proceedings (control and auxiliary function of general courts) 9. Mediation (concept, division, principles) 10. Person of the mediator (conditions for performing the function of a mediator) 11. Course and termination of mediation (mediation agreement) 12. Final comparison between proceedings before general courts, before an arbitrator and before a mediator (commencement, course, termination) 13. Out-of-court settlement of consumer disputes (Financial Arbiter, Czech Trade Inspection Authority) Seminar topics: 1. Advantages and disadvantages of out-of-court dispute resolution 2. Learning outcomes
|
During the semester, students should get acquainted with the issue of dispute resolution outside the system of general courts, from various informal negotiations to binding and enforceable execution titles. The course focuses on the general issue of out-of-court dispute resolution, focusing on two basic methods of out-of-court dispute resolution, which are traditionally established in the legal systems of modern countries, namely arbitration and mediation. After completing the course, students will be able to evaluate the advantages and disadvantages of various forms of out-of-court dispute resolution and define their basic characteristics. They will get information about how to approach out-of-court dispute resolution in everyday life, what to look out for and what they can expect from individual ways of out-of-court dispute resolution and what not.
Students will learn how to think/work and how to deal with cross-border obligations cases.

To obtain the colloquium it is necessary to attend the seminars to the extent set by the supervisor, to participate actively and to fulfill the duties set by the teacher for the given seminar.
